License Agreement
Article 1. General Conditions
- Registration is accessible to students of Erasmus University Rotterdam by means of their ERNA account.
- After registration, you will be notified by e-mail whether your application was accepted.
- Registering is free of charge.
- The customer shall at all times fill out personal information truthfully.
- The customer is responsible for his own account
- Submitting an order entails full comprehension and acceptance of these Agreements.
Article 2. Personal Information
- Entrusted personal information shall only be utilized by Stichting Intermediair Rotterdam (hereafter SIR), and thus shall not be issued to third parties.
Article 3. Product
- Quality is the SIR's number one priority. Nonetheless, the SIR and her writers are not responsible in any way for possible mistakes or consequences of any nature within a report. The SIR reports are an addition to lecture attendance, not a substitution.
- The copying or reproduction, in any way, of the contents of a SIR report is strictly forbidden without written permission from the SIR.
Article 4. Price
- SIR-online prices are stated in terms including tax, excluding any possible administration or delivery costs.
- Price changes and typing errors reserved.
- No rights can be obtained by SIR-online information.
Article 5. Orders
- The SIR is not responsible for any misunderstandings, damaged goods, delays or announcements with regard to any form of communication (among which communication through Internet) between you and the SIR or between the SIR and third parties as far as the relationship between you and the SIR is concerned, that is, unless the matter involves any kind of set-up or clear fault of the SIR.
- The SIR remains the right to refuse handling an order with regard to dubious debtors or orders that are not serious.
- The SIR will handle orders in order of reception.
Article 6. Supply
- Notwithstanding any to the SIR belonging rights, the SIR has the right to choose to cancel the handling of your order or to terminate the agreement in writing to the customer without any legal mediation if there are reasons that are out of the SIR's hands. The SIR is not obliged to compensate the damages, unless this would result in an unacceptable situation, due to considerations of reasonability and fairness. Reasons that are considered out of the SIR's hands comprise every shortcoming that cannot be attributed to the SIR, because the SIR's fault is not demonstrably present or the SIR is not legally accountable.
- The estimated time of the arrival of a delivery as mentioned on the website is only indicative. Exceeding the delivery period gives no right to compensation for damages, nor does it give right to cancel an order or to terminate the agreement without costs. However, this does not apply if the exceeding of the deadline is of a certain excessive time period that it is not reasonable for the SIR to expect you to continue the agreement, in which case you have the right to cancel your order or to terminate the agreement if necessary.
- SIR is not accountable for goods that are incorrectly delivered by third parties.
Article 7. Authorization of payment
- By placing an order at the SIR you give the SIR the order and authorization to take care of your order (and sending it, if applicable) at your expense. Every order involves an administration fee (and a delivery charge, if applicable). You pay a fixed amount of € 0,70, no matter the amount of reports you ordered within one order. Goods will only be delivered at the address that has been registered in the SIR administration by the customer.
Article 8. Returning goods
- The customer will check whether the goods correspond with the placed order.
- It is not possible to cancel an outstanding order or to return an already delivered package.
- Goods that have been sent to a customer without the customer having actually placed an order can be returned at the expense of the SIR.
Article 9. Term of payment
- If payment is being rejected because of a lack of credit, the customer has to make the payment within 14 days from the date of the invoice.
Article 10. Exhortation
- If the SIR has to urge the customer to pay after the term of payment has expired, the total amount will be raised by an administration fee of 5 euro.
- If the SIR has to outsource the handling of the claim to a third party, all costs involved (law- and non-law related) will be at the expense of the customer.
- The payments that the customer makes will be subtracted from the total outstanding debts (total amount of order plus costs).
Article 11. Non-payment of bills
- Whenever a customer does not pay his bills, the SIR will remain the right to refuse providing its services to the customer in the future.
Article 12. Legal form and deposition
- Dutch law applies to this license agreement
- This license agreement applies to all relationships between SIR and her customers.
- Disputes between parties will be presented to the authorized officer of law in Rotterdam.
